Terms and Conditions
 

1.Travel Contract

The travel contract is subject to the Law n. 1084, ratified on December 27, 1977, as per the Bruxelles International Convention of Travel Contract (CCV) dated April 23, 1970; and subject to the D. Legs. N. 111, March 17, 1995, in accordance with the directive 314/90/CEE about tourist packages; and also to the other laws in force about this subject and on the prevision of the C.C., as much as they are not derogated from the prevision of the present contract.

2.Reservations

The booking has to be made on a special form, properly completed in each part and signed. Reservation acceptances by CPT Tour, hereafter named the Organizer-Tour Operator, are subject to availability and are considered ratified only when confirmed in writing by the Organizer-Tour Operator. In accordance with Art. 6 of the D. Legs. 111/95, intermediary sellers (travel agencies etc) may only issue copy of the contract to the client after receiving written confirmation by the Organizer-Tour Operator.

3.Payment

The Organizer-Tour Operator request a down payment of 30% of the total amount and balance is due 30 days prior to departure. In case of bookings made less than 30 days prior to departure, the Organizer-Tour Operator will request the payment of the full amount at the moment of the confirmation of reservation. If the Organizer-Tour Operator does not receive payment in the above-mentioned terms, the contract will be considered invalid and compensation for further damages suffered by the Organizer-Tour Operator can be demanded.

4.Prices and fees

The prices and fees are quoted in EUROS and are established by the Organizer-Tour Operator according to transportation and accommodation costs, therefore subject to current exchange rates at the moment of printing the travel contract. Claims about the fees will be considered once the journey has taken place. The participant has to establish beforehand if prices and fees are acceptable and that a series of services is included, about which it is impossible to give details.

5.Transfer of the travel contract

Registered clients may be replaced by a third party on condition that a) the registered participant is unable to make use of the service as per contract; b) third party satisfy all conditions for the fruition of the service as per contract; c) communication of the transfer and third party details to the Organizer-Tour Operator is done in writing up to 4 days before the commencement of the trip; d) third party can fulfil all requirements about visa, licence, passport, medical certificate, vaccination and complies with agreed services as per contract; e) third party agrees to refund the Organizer-Tour Operator for processing fees due to the change of reservation.

The Organizer-Tour Operator will not be held responsible if participation of a third party is opposed by a service supplier. Registered participants and third party are responsible for payment as per letter e) of this section.

6.Price changes – Modification of the package tour

All prices are subject to change according to current exchange and market rates, therefore the Organizer-Tour Operator is entitled to change the prices of the advertised products up to 20 days before the commencement of the trip, as a result of variations in a) transportation and fuel costs; b) duties and taxes as, for example, landing and embarkation taxes in ports and airports; c) exchange rates; d) costs for heating (only for self contained group holiday houses).

If before the date of departure, the Organizer-Tour Operator has to make a significant modification of an essential element of the contract, including the price, the client has to be informed accordingly in due time. Significant modifications are considered a over 10% rise of the agreed price or changes of basic elements of the tourist package. The client who has been advised accordingly can recede from the contract without penalty, or can accept the modifications, which will then specified and detailed in the contract. If the client does not reply within 2 working days, the modifications are considered accepted. In case the Organizer-Tour Operator cannot provide any essential part of the services specified in the contract when the client is already arrived, it is obliged to provide with alternative solutions without additional charges; if the alternative arrangements are of inferior quality, the Client is entitled to a refund of the difference. If they do not meet the standards specified in the contract, the Organiser-Tour Operator will have to refund the client accordingly. If no alternative solution is possible or the client have serious, justified and proved reasons to refuse it, the Organizer-Tour Operator will provide free of charge scheduled transportation similar in all aspects to that originally contracted to the place of origin or to a different place agreed with the client. If also this solution is not possible, for no fault of the Organiser-Tour Operator, the client will be refunded accordingly by cash or by a coupon.

7.Changes by the client

Any modification requested by the client after the confirmation of the reservation is binding for the Organizer-Tour Operator only if it is possible to satisfy them. In any case the client will be charged with all the costs and penalties suffered by the Organiser-Tour Operator for the services cancelled or changed.

8.Cancellation and penalty

The client is entitled to cancel the contract in writing and via registered post before the commencement of the trip. Cancellation fees will be applied as follows: 30% of the full amount up to 30 days prior departure; 50% from 29 to 21 days prior departure; 75% from 20 to 11 days prior departure; 100% of the full amount after that term. The Organizer-Tour Operator can withhold the above mentioned penalties from the deposit paid. Reservation and registration fees are not refundable. Should, for no fault of his own, the client decide not to commence the trip, interrupt it earlier than as per contract or not to take part to planned part of the agreed programme, he will not be entitled to a refund.

9.Substitution of service and/or service providers by the Organizer-Tour Operator

The Organizer-Tour Operator can replace at any moment and without mention or debit services and service providers with others of similar standard as per contract, for reasons beyond one’s control or any other reasonable cause.

10.Hotel classification

In case of missing hotel official classification, the Organizer-Tour Operator will provide its own on the basis of its personal evaluation and professional experience.

11. Cancellation of the travel by the Organiser-Tour Operator

If the Organizer-Tour Operator communicates the impossibility to carry out the services as per contract prior to departure, the client can recede without penalty. The Organizer-Tour Operator has the right to cancel the contract if a minimum number of participants is not reached and the client must be informed in writing at least 10 days prior to departure and fully refunded within 7 working days after the communication.

12. Liability of the client

The client will have to provide for all the necessary travelling documents and visa (when necessary) and for all the vaccinations or any other medical check (if requested). The client is also liable to comply to all the rules and regulations as per contract and in accordance with the specification of local and governmental authorities. The client will be held personally responsible for any damage the Organiser-Tour Operator will incur and will have to refund it in full.

13.Liability of the Organiser-Tour Operator

The Organiser-Tour Operator is liable for damages caused to the client by the non-execution of the services as per contract, when it is not proved that the faults are due to the client behaviour, to that of third parties alien to the contract or to unforeseen or accidental events. If the quality of the service provided is compromised by the service provider (other than the Organiser-Tour Operator), the client is entitled to a refund from the Organiser-Tour Operator, which is entitled to a refund from the service provider. The Organizer-Tour Operator cannot be held responsible for circumstances beyond its own control (strike, delay, unfavourable atmospheric condition, lost baggage, natural disaster, civil or military disorder, war, epidemic, technical problem, etc.) and therefore all the changes due to the above-mentioned causes will be charged to the client.

14.Limit of compensation

The compensation for any kind of damage (to the person or other) inside and outside the contract is regulated by the laws in force; the current international conventions are : the 1929 Warsaw Convention about the International Air Transport; 25/02/1961 Berna Convention of Berna about Railroad Transport; 23/04/1970 Bruxelles Convention about Travel Contract.

15.Assistance services

The Organizer-Tour Operator grants all the due assistance to the client so that he can take part to the programme as per contract. The client will have to refund the Organiser-Tour Operator for any intervention due to the client negligence or irresponsible behaviour, to third parties alien to the contract, or to circumstances beyond the Organiser-Tour Operator’s control.

16.Obbligations of the participating for the right of subrogation for the Organizer

The client has to supply as soon as possible to the Organizer-Tour Operator all the documents and information to make the Organizer-Tour Operator able to exercise the right of subrogation as per Art.18 of D. Leg. n. 111 of March 17, 1995.

17.Luggages

Client’s luggage is sole responsibility of the client and the Organiser-Tour Operator cannot be held responsible for delay, damages of loss.

18.Insurance

CPT Tour is covered by an insurance policy of civil liability; Mondial Italia S.p.a, n. 161102, April 26, 2006.

19.National Security Fund

The Italian Government grants access to a national security fund to refund the client and to provide to the client’s transfer, in case of bankruptcy of the Organiser-Tour Operator. Access to the fund is limited as per Art. 21 D. Leg. n. 111 of March 17, 1995.

20.Objections and claims

Through the service provider or the tour leader, the client has to inform immediately the Organizer-Tour Operator of any lack of service as per contract, so that a quick alternative solution can be found. At the end of the trip the client has to present his claim in writing by registered post within 10 working days from the day of his arrival.

21.Place of jurisdiction

The place of jurisdiction is Cuneo.

22.Compulsory communication according to the art. 16 of the law 296/98.

The Italian law punishes with the imprisonment the crime of prostitution and juvenile pornography, also if these are committed in a foreign country.

Addendum

HOLIDAY HOUSES – PAYMENT
Once the client receives confirmation of the booking of a self contained holiday home, the payment of the balance and all the extra fees (electricity, gas…..) has to be done at the end of the stay.
OFFERS AND DISCOUNTS
It is not permitted to use more than one offer at the same time (if not else specified) and the discounted prices will only apply upon availability.
While making the reservation, the client has to communicate to the Organiser-Tour Operator the preferred offer.
Details of offers. 1) SLOWFRIEND BONUS: one free B&B stay and a SLOWTOURIST present after 5 bookings of products from our catalogue (bonus does not apply to self contained holiday homes). Reservations have to be of minimum 2 nights B&B in double room, or 1 night HB in double room. The offer expires after 2 years from the first reservation, including the free stay. 2) ADVANCED BOOKING. Up to 20% discounts on the advertised prices for bookings confirmed and paid in full at least 50 days prior to departure. 3) OFFER OF THE MONTH. Every month we offer a discounted package holiday. 4) SLOWTOURIST SPECIAL. On bank holidays, special occasions and festivities, we choose for you the most convenient rates. The Slowtourist Special will count as 1 point for the SLOWFRIEND BONUS (see 1) of this section).
